Deferments
- Deferments can be raised by any party associated with the filing. The request must be properly raised in the deferment section and include supporting evidence.
- Any party within the filing may subsequently challenge the deferment.
- If challenged, the arbitrator will weigh all arguments and evidence presented to determine if the deferment request should be granted or denied.
- A quality decision explanation:
- Addresses the arguments raised by each party.
- States the evidence that influenced the decision and how the evidence items impacted the decision.
- Connects the dots between the arguments, evidence, and the decision.
- The new shared evidence badge shows where evidence was attached to the filing.
- Damage evidence attached when the arbitration was initially filed will show it was attached to the “Feature Damages.” Damage evidence attached during a damage dispute revisit will show it was attached to the “Damage Dispute Revisit.”
